Welcome to CENT'ANNII. The terms "we", "us" and "our" refer to CENT'ANNII, an online retailer of pre-owned and new-with-tags clothing based in Houston, Texas, United States. CENT'ANNII operates this website, centannii.com, including all related information, content, features, tools, products and services (the "Services"). We also sell through third-party marketplaces such as eBay; purchases made on those marketplaces are governed by that marketplace's terms. CENT'ANNII is powered by Shopify.

These terms and conditions, together with the policies referenced below (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you have given consent for any of your minor dependents to use the Services on devices you own, purchase or manage.

SECTION 2 - OUR PRODUCTS AND THEIR CONDITION
Most items we sell are pre-owned, one-of-a-kind pieces. Some items are new with tags. The condition of each item is stated on its product page, together with photographs and a description of any visible wear, marks or flaws we have identified.
Pre-owned items have been worn before and may show normal signs of use consistent with their stated condition. We inspect each pre-owned item before listing it and describe its condition as accurately as we can. Please review the photos, measurements and condition notes before purchasing, and contact us with any questions.
Colors may appear differently on your screen depending on your device and its settings.
Because most items are single pieces, quantities are limited. An item may sell through another of our sales channels before your order is completed; if that happens, we will notify you and issue a full refund for that item.
We may update product descriptions, discontinue products, or limit quantities offered to any person or region at any time.

SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Your order is accepted when we confirm it, and we must receive and process your payment before your order is accepted. We may decline or cancel an order, for example if an item is no longer available or if there is an error in the listing. If we decline, change or cancel your order, we will notify you using the email, billing address or phone number provided with the order and refund any amount charged for the affected items.

You agree that your purchases are for your own personal or household use.

SECTION 4 - PRICES AND BILLING
Prices are shown in the currency selected on our website. The price charged is the price in effect when your order is placed, as shown in your order confirmation email. Shipping costs and applicable taxes are calculated and shown at checkout before you complete your purchase. Prices on our website may differ from prices for the same item on third-party marketplaces. Promotions, when offered, are governed by their stated terms; if a promotion's terms conflict with these Terms, the promotion terms apply.

SECTION 5 - SHIPPING AND DELIVERY
Orders ship from Houston, Texas, United States. Processing times, shipping methods, costs, delivery estimates and the countries we ship to are described in our Shipping Policy (https://centannii.com/policies/shipping-policy) and shown at checkout. Delivery times are estimates and may be affected by carrier delays, customs processing or events outside our control. If your package is lost or damaged in transit, contact us and we will help resolve it with the carrier.

The content of the Services, including text, photographs, graphics and the design and arrangement of the site, is owned by CENT'ANNII or its licensors and is protected by copyright and other intellectual property laws. CENT'ANNII's name and logo are trademarks of CENT'ANNII. Brand names of the clothing we resell belong to their respective owners and are used only to describe the items accurately. CENT'ANNII is an independent reseller and is not affiliated with, authorized by or endorsed by those brands unless expressly stated.

SECTION 7 - THIRD-PARTY TOOLS AND LINKS
The Services may include tools or links provided by third parties. We do not control these third parties and are not responsible for their content, products or practices. Your use of third-party tools or websites is at your own risk and subject to their terms.

SECTION 8 - RELATIONSHIP WITH SHOPIFY
CENT'ANNII is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with CENT'ANNII. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and CENT'ANNII, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with CENT'ANNII.

Pre-owned items are sold in the condition described on their product page. To the extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you. Nothing in these Terms limits your rights under our Refund Policy or any rights you have under applicable consumer protection law.

SECTION 15 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, CENT'ANNII and Shopify will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Services or any product purchased through them. Our total liability for any claim related to an order will not exceed the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited by law.

SECTION 16 - INDEMNIFICATION
You agree to indemnify and hold harmless CENT'ANNII and Shopify from claims, losses and reasonable legal fees arising from your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 17 - SEVERABILITY, WAIVER AND ENTIRE AGREEMENT
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms, together with the policies linked above, are the entire agreement between you and CENT'ANNII regarding the Services.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours as part of a reorganization or sale of the business.

SECTION 19 - GOVERNING LAW
These Terms are governed by the laws of the State of Texas and applicable United States federal law. Any dispute will be handled in the state or federal courts located in Harris County, Texas, unless the consumer protection laws of your country or state give you the right to bring a claim where you live.
